Respect for Intellectual Property

ITZCULTURE, Inc. ("Platform") respects the intellectual property rights of others and expects all users to do the same. We comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and respond promptly to valid notices of alleged copyright infringement.

Please direct all copyright infringement notices to the agent listed above. Notices sent to other contacts may not receive a timely response.

Filing a DMCA Takedown Notice

If you believe that content on our Platform infringes your copyright, please submit a written notification containing the following information:

  • Identification of the copyrighted work: Describe the copyrighted work you believe has been infringed, or provide a URL where it can be found.
  • Identification of infringing material: Provide the specific URL(s) on our Platform where the allegedly infringing content is located. Be as specific as possible to help us locate the material.
  • Your contact information: Full legal name, mailing address, telephone number, and email address.
  • Good faith statement: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • Accuracy statement: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
  • Signature: Your physical or electronic signature (typing your full legal name constitutes an electronic signature).

Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that content is infringing may be subject to liability for damages, including attorney's fees. If you are not certain that the use of the material constitutes infringement, consider consulting an attorney before filing a notice.

Our Response to Valid Notices

Upon receiving a valid DMCA takedown notice, we will:

  • Remove or disable access to the allegedly infringing material promptly (typically within 24-48 hours)
  • Notify the user who posted the content that it has been removed and provide them with a copy of the takedown notice
  • Record the notice as a "strike" against the user's account

Filing a Counter-Notice

If you believe your content was removed in error or that you have authorization to use the material, you may submit a counter-notice containing:

  • Identification of removed content: A description of the material that was removed and the URL where it appeared before removal.
  • Good faith statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Delaware if outside the US), and that you will accept service of process from the person who provided the original takedown notice.
  • Your contact information: Full legal name, address, phone number, and email.
  • Signature: Your physical or electronic signature.

Upon receiving a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10-14 business days, we will restore the removed content.

Repeat Infringer Policy

We maintain a strict repeat infringer policy:

  • First strike: Content removed, written warning issued
  • Second strike: Content removed, 7-day account suspension, final warning
  • Third strike: Permanent account termination without appeal

Strikes remain on an account indefinitely. We may terminate accounts with fewer than three strikes in cases of willful or commercial-scale infringement.

Trademark Claims

For trademark infringement (as distinguished from copyright infringement), please email legal@itzculture.com with:

  • Proof of trademark registration (registration number and jurisdiction)
  • Identification of the infringing listing(s) on our Platform
  • Description of how the listing infringes your trademark rights
  • Your contact information and signature

Trademark claims are reviewed within 5 business days.

Good Faith and Misuse

We take the DMCA process seriously and expect all parties to act in good faith. Abuse of the DMCA process — including filing false takedown notices to harass competitors or suppress legitimate content — may result in account termination and potential legal liability under 17 U.S.C. § 512(f).
